General TERMS AND CONDITIONS OF SALE

  1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
  2. Sales of Alcoholic Beverages are only allowed for adults 21 years and older
  3. Beer Shipped to you must be signed for by a 21 year old adult with valid photo id.
  4. Our invoices due at the time of order, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Angry Horse reserves the right to request a fixed interest payment amounting to 1% of the sum remaining due.
  5. If a payment is still outstanding more than sixty (60) days after the due payment date, The Company reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
  6. Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can My Company become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to My Company in its entirety and does not include any costs relating to the legislation of the country in which the client is located. 
  7. All our contractual relations will be governed exclusively by United States law.

TERMS AND CONDITIONS OF SALE to retailer and/or distributor

  1. Approval - Sales to retailer and distributors are only allowed after verifying the ABC License and sellers permit
  2. Credit - All sales are COD unless pre-approved for Net 30 credit.
    1. For accounts with credit, the invoice is due within 30 days of the delivery date.  Any unpaid invoice beyond this date will be considered past due.
    2. In accordance with (27 CFR 6.65 to 6.67) all invoices  that aren't paid within 30 days of the date of delivery MUST be charged interest. 
    3. Angry Horse Brewery will charge a 1% surcharge as well as another 1% of the invoice total for every additional 30 days.
      1. In California, Section 25509 of the Business and Professions Code required that if any accounts debt goes over 42 days, there is a mandatory 1% surcharge that must be collected before the COD requirement can be lifted, as well as another 1% payment for every additional 30 days.
    4. Net 30 accounts whose account are in arrears must pay for all new orders in advance or on delivery an amount equal to or greater than the value of each order.
    5. If a payment is still outstanding more than sixty (60) days after the due payment date, The Company reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
  3. Returns - Please confirm orders for accuracy prior to delivery.  Once products are delivered returns will not be accepted with the following exceptions:
    1. If products are delivered in excess of those ordered they can be returned 15 days after delivery, after 15 days permission has to be sought from the ABC to make returns.
    2.  Angry Horse MAY accept the return of beer that meet the following criteria with prior written approval:

      2. Beer purchased from a seasonal or temporary licensee if at the termination of the period of the license the seasonal or temporary licensee has beer remaining unsold, or from an annual licensee operating on a temporary basis if at the termination of the temporary period the annual licensee has beer remaining unsold.
      3. A brand of beer discontinued in a California market area or a seasonal brand of beer from a retail licensee, provided that the beer is exchanged for a quantity of beer of a brand produced or sold by the same manufacturer with a value no greater than the original sales price to the retail licensee of the returned beer.
      4. If any product is considered to have product quality health or safety issues. The returned beer would need to be exchanged for identical product, if inventory is unavailable, issue a deferred exchange memorandum showing the beer was picked up and is to be replaced when inventory is available.  Returns for product quality issues are subject to ABC approval, and shall not include the return of beer due to the aging of beer.
